The charge alleges that he provided medical care to a former colleague and therefore failed to maintain professional boundaries. The matter was resolved through post-charge alternative dispute resolution (ADR) when Dr. Franko signed an undertaking agreeing to complete a course on professional boundaries within 6 months and to not pick up, dispense, administer, or otherwise handle opioid prescriptions for any patients. Council imposed the following penalty: 1) a suspension for six months retroactive to when Dr. Franko left practice; 2) a prohibition against practising as an emergency room physician. The prohibition did not prevent Dr. Franko from providing care in an emergency department if he is on call or treating his own patients; 3) a prohibition against practising in any medical clinic where opiates are available; 4) a prohibition against prescribing any opiate; 5) a requirement that he participate in Physician Support Program of the Saskatchewan Medical Association, participate in a program of random fluid screening through the Physician Support Program and to follow the recommendations of the program. Council subsequently altered the restrictions to permit Dr. Franko to practise in a medical clinic where opiates are available. Charges
